Terms of Service

1. Acceptance of terms

By accessing and using Mensula ('the Service'), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service.

2. Description of service

Mensula is an architectural design and visualization platform. The Service is currently in closed alpha and features may change, be added, or be removed at any time without prior notice.

3. Alpha program

The Service is provided in its current state as a closed alpha release. By participating in the alpha program, you acknowledge and agree that: (a) the Service may contain bugs, errors, and incomplete features; (b) the Service may be unavailable, unstable, or experience downtime without prior notice; (c) data created during the alpha period may be lost, corrupted, or deleted during updates, migrations, or at the end of the alpha program — we recommend keeping local backups of any important work; (d) features available during the alpha may be modified, removed, or significantly changed in future releases; (e) no uptime, performance, or reliability guarantees are provided during the alpha period. We appreciate your participation and any feedback you provide. By submitting feedback, suggestions, or bug reports, you grant Mensula a non-exclusive, royalty-free license to use that feedback to improve the Service.

4. User accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating an account.

5. Account URLs and naming

When you create an account or organization, you may choose a URL identifier (slug) that becomes part of your public web address (e.g., app.mensula.io/your-name). You agree that: (a) you will not choose identifiers that impersonate other people, companies, or organizations; (b) you will not use identifiers that contain profanity, hate speech, or offensive language; (c) certain identifiers are reserved by Mensula for current or future use, including product features, platform terms, and brand-related names — these cannot be claimed; (d) Mensula reserves the right to reclaim, reassign, or disable any identifier at any time, with or without notice, including but not limited to identifiers that violate these terms, infringe on trademarks, or are needed for platform operations; (e) you will not squat on identifiers — accounts created primarily to reserve identifiers without genuine use may be reclaimed. This policy exists to maintain a clean, trustworthy namespace for all users.

6. Acceptable use

You agree not to use the Service for any unlawful purpose or in any way that could damage, disable, or impair the Service. You may not use the Service to generate content that infringes on the intellectual property rights of others. You may not: (a) create multiple accounts to obtain additional free credits or circumvent usage limits; (b) use temporary, disposable, or throwaway email addresses to create accounts; (c) use automated tools, bots, or scripts to create accounts or interact with the Service; (d) share, sell, or transfer account credentials or credits to third parties. Mensula reserves the right to suspend or terminate accounts that violate these terms, reclaim credits obtained through abuse, and restrict access without prior notice. When participating in any Mensula community space, the additional rules in section 10 (Community participation) also apply.

7. AI-generated content and ownership

You retain full ownership of all content you create using the Service, including AI-generated renders and visualizations. Mensula does not claim any ownership, license, or usage rights over your content. We will never use your projects, renders, or uploads for marketing, training, or any other purpose without your explicit written consent. AI-generated outputs may not be unique — other users using similar inputs may receive similar results. Mensula does not guarantee that AI-generated content is free from third-party intellectual property claims.

8. Third-party AI providers

The Service uses third-party AI model providers (including but not limited to Google, OpenAI, and others) to generate renders, visualizations, and chat assistance. When you use AI features, your inputs (such as prompts, images, and project data) are sent to these providers for processing. These providers process your data under their own terms and privacy policies. We select providers that offer enterprise-grade API agreements where your data is not used for model training. However, we cannot guarantee the practices of third-party providers beyond our contractual agreements with them. The specific providers used may change as we add, remove, or replace AI models.

9. Product analytics and session recording

To understand how the Service is used and to improve it, we collect product analytics events (pageviews, clicks, key product actions) and full session recordings of your use of the application. Sensitive content — including form inputs, render prompts, and other user-generated text — is masked client-side before any recording is sent. Both analytics and recordings rely on PostHog Cloud (European Union region) running in 'Cookieless server-hash mode': nothing is written to your device, and identifiers cannot persist across days. Sentry (also EU region) additionally captures short session recordings only when an error occurs, so we can debug crashes. The lawful basis is our legitimate interest in operating and improving the Service. By creating an account you acknowledge this processing; you may object at any time by contacting [email protected] (an in-product privacy settings page is in development). 10. Community participation

Mensula operates a community forum at community.mensula.io (Discourse-based) and may publish links to optional chat channels run by third parties (for example, a Telegram group). Participation is voluntary and not required to use the Service. By participating in any Mensula-operated community space you agree to: (a) be respectful and constructive in your interactions; (b) not post unlawful, harassing, defamatory, hateful, or otherwise abusive content; (c) not post spam, off-topic promotional content, or automated messages; (d) not impersonate other users, Mensula staff, or third parties; (e) not share other users' personal information without their explicit consent. We reserve the right to edit or remove content, suspend community access, or permanently ban users who violate these terms, with or without prior notice. Suspension or removal from the community does not by itself affect your access to the main Mensula application unless the underlying conduct also violates these Terms in the application context. You retain ownership of content you post in the community; by posting, you grant Mensula a non-exclusive, royalty-free, worldwide license to display, store, back up, and moderate that content as necessary to operate the community. External chat channels (such as Telegram) are operated by third parties under their own terms; we are not responsible for their availability, content moderation, or data practices, and any data you share there is governed by the third party's policies rather than ours.

11. Subscriptions and billing

Paid plans are billed in advance on a monthly or annual basis. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period. No refunds are provided for partial billing periods. During the alpha period, pricing and plan features may change — existing subscribers will be notified of any changes in advance.

12. Cancellation and refunds

You may cancel your subscription at any time from your account settings. Upon cancellation, you will retain access until the end of your current billing period. We do not provide refunds for unused time. If you are within the first 14 days of your initial subscription and have not consumed any AI credits (renders, chat assistance, or other AI-powered features), you may request a full refund by contacting [email protected]. By using AI-powered features, you acknowledge that the digital service has begun to be delivered and you waive your right of withdrawal under EU Directive 2011/83/EU for the credits consumed.

13. Intellectual property

The Service and its original content, features, and functionality are owned by Mensula and are protected by international copyright, trademark, and other intellectual property laws. Your content remains yours.

14. Limitation of liability

To the maximum extent permitted by law, Mensula shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service. This includes, without limitation, any loss of data, loss of profits, or business interruption arising from the alpha nature of the Service.

15. Changes to terms

We reserve the right to modify these terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new terms.
